Welcome to Ivingo Creative. These Terms of Service (“Terms”) govern your use of our website and the services we provide. By accessing www.ivingocreative.com or engaging our services, you agree to these Terms. Please read them carefully.

1. Overview

Ivingo Creative (“we,” “our,” “us”) provides web design, SEO, website optimization retainers, digital marketing strategy, and related services to small businesses. These Terms apply to all clients, customers, and site visitors.

2. Services Provided

Our offerings include, but are not limited to:

  • Signature Web Design
  • SEO Audits & Implementation
  • Monthly Website Optimization Retainers
  • Marketing Strategy & Content Development
  • Website Audits & Consulting

All deliverables, timelines, and scope of work are defined in your individualized proposal or agreement.

3. Payments and Billing

Payments are processed securely through Stripe. We accept all major credit cards.

  • Payment terms are outlined in your proposal or invoice.
  • Late payments may incur a 5% monthly fee.
  • Monthly retainers and subscriptions are automatically billed on a recurring basis until canceled.

Refunds: Due to the nature of custom digital services and strategy work, all payments are non-refundable once work has begun.

4. Cancellations and Termination

You may cancel any ongoing service with 30 days’ written notice.

Cancellations received after a billing date will apply to the following month.

We may terminate services immediately for:

  • Non-payment
  • Abusive or inappropriate behavior
  • Breach of these Terms
  • Lack of communication for 30+ days on an active project

If termination occurs, payments made to date are non-refundable.

5. Client Responsibilities

You agree to:

  • Provide required materials, content, and approvals in a timely manner
  • Respond to communication within a reasonable timeframe
  • Review and approve deliverables promptly
  • Pay invoices by their due dates

Delays caused by missing materials or communication may impact deadlines and may result in additional fees.

6. Intellectual Property

All custom design assets, copy, strategy, documents, and materials created by Ivingo Creative remain our intellectual property until the final invoice is paid.

Upon full payment:

  • Ownership of final deliverables transfers to you

  • We retain rights to:

    • showcase your project in our portfolio

    • share anonymized case-study results

    • display screenshots or excerpts for marketing purposes

Source files (such as raw design files) are not included unless specifically stated in your agreement.

7. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services. Our total liability is limited to the amount paid by you in the 3 months preceding the claim.

8. Privacy

Your information is handled in accordance with our Privacy Policy (link to your privacy policy). We do not sell or share your data with third parties except as required to deliver our services or by law.

9. Changes to Terms

We may update these Terms from time to time. Continued use of our services or website after changes constitutes acceptance of the revised Terms.
